Revocation of your consent to the processing of data

A wide range of data processing transactions are possible only subject to your express consent. You can also revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

Right to object to the collection of data in special cases; right to object to direct advertising (Art. 21 GDPR)

In the event that data are processed on the basis of Art. 6 Sect. 1 lit. e or f GDPR, you have the right to at any time object to the processing of your personal data based on grounds arising from your unique situation. Right to log a complaint with the competent supervisory agency

In the event of violations of the GDPR, data subjects are entitled to log a complaint with a supervisory agency, in particular in the member state where they usually maintain their domicile, place of work or at the place where the alleged violation occurred. The right to log a complaint is in effect regardless of any other administrative or court proceedings available as legal recourses.

Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. Right to demand processing restrictions

  • In the event that you should dispute the correctness of your data archived by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.
  • If we do not need your personal data any longer and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.

If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section „Information Required by Law“ to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular retention periods.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all resulting personal data (name, request) will be stored and processed by us for the purpose of processing your request. We do not pass these data on without your consent.

The processing of these data is based on Art. 6 para. 1 lit. b GDPR, if your request is related to the execution of a contract or if it is necessary to carry out pre-contractual measures. In all other cases, the processing is based on your consent (Article 6 (1) a GDPR) and/or on our legitimate interests (Article 6 (1) (f) GDPR), since we have a legitimate interest in the effective processing of requests addressed to us.

The data sent by you to us via contact requests remain with us until you request us to delete, revoke your consent to the storage or the purpose for the data storage lapses (e.g. after completion of your request). Mandatory statutory provisions - in particular statutory retention periods - remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only to the extent necessary for the establishment, content organization or change of the legal relationship (data inventory). These actions are taken on the basis of Art. 6 Sect. 1 lit. b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual actions. We collect, process and use personal data concerning the use of our website (usage data) only to the extent that this is necessary to make it possible for users to utilize the services and to bill for them.

The collected customer data shall be eradicated upon completion of the order or the termination of the business relationship. This shall be without prejudice to any statutory retention mandates.

Data transfer upon closing of contracts for online stores, retailers and the shipment of merchandise

We share personal data with third parties only if this is necessary in conjunction with the handling of the contract; for instance, with companies entrusted with the shipment of goods or the financial institution tasked with the processing of payments. Any further transfer of data shall not occur or shall only occur if you have expressly consented to the transfer. Any sharing of your data with third parties in the absence of your express consent, for instance for advertising purposes, shall not occur.

The basis for the processing of data is Art. 6 Sect. 1 lit. b GDPR, which permits the processing of data for the fulfilment of a contract or for pre-contractual actions.

4. Analysis tools and advertising

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider of this service is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called cookies. Cookies are text files, which are stored on your computer and that enable an analysis of the use of the website by users. The information generated by cookies on your use of this website is usually transferred to a Google server in the United States, where it is stored.

The storage of Google Analytics cookies and the utilization of this analysis tool are based on Art. 6 Sect. 1 lit. f GDPR. The operator of this website has a legitimate interest in the analysis of user patterns to optimize both, the services offered online and the operator’s advertising activities.

IP anonymization

On this website, we have activated the IP anonymization function. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases. On behalf of the operator of this website, Google shall use this information to analyse your use of this website to generate reports on website activities and to render other services to the operator of this website that are related to the use of the website and the Internet. The IP address transmitted in conjunction with Google Analytics from your browser shall not be merged with other data in Google’s possession.

Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Archiving period

Data on the user or incident level stored by Google linked to cookies, user IDs or advertising IDs (e.g. DoubleClick cookies, Android advertising ID) will be anonymized or deleted after 14 month. For details please click the following link: support.google.com/analytics/answer/7667196

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online promotional program of Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

In conjunction with Google AdWords, we use a tool called Conversion Tracking. If you click on an ad posted by Google, a cookie for Conversion Tracking purposes will be placed. Cookies are small text files the web browser places on the user’s computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not yet expired, Google and we will be able to recognise that the user has clicked on an ad and has been linked to this page.

A different cookie is allocated to every Google AdWords customer. These cookies cannot be tracked via websites of AdWords customers. The information obtained with the assistance of the Conversion cookie is used to generate Conversion statistics for AdWords customers who have opted to use Conversion Tracking. 5. Plug-ins and Tools

YouTube with expanded data protection integration

Our website uses plug-ins of the YouTube platform, which is being operated by Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the expanded data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Nevertheless, this does not necessarily mean that the sharing of data with YouTube partners can be ruled out as a result of the expanded data protection mode. For instance, regardless of whether you are watching a video, YouTube will always establish a connection with the Google DoubleClick network.

As soon as you start to play a YouTube video on our website, a connection to YouTube’s servers will be established. As a result, the YouTube server will be notified, which of our pages you have visited. If you are logged into your YouTube account while you visit our site, you enable YouTube to directly allocate your browsing patterns to your personal profile. You have the option to prevent this by logging out of your YouTube account.

Furthermore, after you have started to play a video, YouTube will be able to place various cookies on your device. Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g. via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g. contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6 Sect. 1 lit. b GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6 Sect. 1 lit. a GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we should not be able to offer you a position, if you refuse a job offer, retract your application, revoke your consent to the processing of your data or ask us to delete your data, we will store your transferred data, incl. any physically submitted application documents for a maximum of 6 months after the conclusion of the application process (retention period) to enable us to track the details of the application process in the event of disparities (Art. 6 Sect. 1 lit. f GDPR).

YOU HAVE THE OPTION TO OBJECT TO THIS STORAGE/RETENTION OF YOUR DATA IF YOU HAVE LEGITIMATE INTERESTS TO DO SO THAT OUTWEIGH OUR INTERESTS.

Once the retention period has expired, the data will be deleted, unless we are subject to any other statutory retention obligations or if any other legal grounds exist to continue to store the data. If it should be foreseeable that the retention of your data will be necessary after the retention period has expired (e.g. due to imminent or pending litigation), the data shall not be deleted until the data have become irrelevant. Nameni in pravne podlage obdelave podatkov
Vaše osebne podatke obdelujemo ob upoštevanju Splošne uredbe EU o varstvu podatkov (GDPR) ter drugih predpisov s področja varstva osebnih podatkov.
Pri nas zavarujete jamstvo za vozilo, ki ga prejmete pri trgovcu. Za sklenitev zavarovalne pogodbe in oceno tveganja, ki ga prevzamemo, potrebujemo od vas podatke iz zavarovalne pogodbe. Če je zavarovalna pogodba sklenjena, obdelamo te podatke zaradi izpolnjevanja pogodbenih obveznosti. Navedbe o škodi potrebujemo npr. za preverjanje, ali je nastopil zavarovalni primer in kolikšna je škoda.

Sklenitev oz. izvajanje zavarovalne pogodbe za jamstvo ni mogoča brez obdelave vaših osebnih podatkov.

Poleg tega potrebujemo vaše osebne podatke za ustvarjanje statistik, specifičnih za zavarovanje, npr. za oblikovanje novih tarif ali izpolnitev zahtev iz pravnih predpisov.
Pravna podlaga za te obdelave osebnih podatkov za predpogodbene in pogodbene namene je člen 6, odstavek 1 b) GDPR.
Vaše podatke obdelujemo tudi, da bi varovali lastne upravičene interese ali upravičene interese tretjih oseb (člen 6, odstavek 1 f) GDPR). To je lahko zlasti potrebno:

  • zaradi zagotavljanja varnosti IT in delovanja IT,
  • zaradi trženja lastnih zavarovalnih produktov,

Kategorije prejemnikov osebnih podatkov
Dajalec zavarovanja:
Tveganja, ki jih prevzamemo, zavarujemo pri posebnih zavarovalniških družbah (dajalcih zavarovanja). Zato je lahko nujno, da vaše podatke iz pogodbe in po potrebi podatke o škodi posredujemo dalajcu zavarovanja, tako da si lahko ta ustvari predstavo o tveganju ali zavarovalnem primeru.

Proizvajalec/uvoznik vozil:
Pri dogovorjenih jamstvenih oz. zavarovalnih shemah, dogovorjenih s proizvajalci oz. z uvozniki vozil, so vaši podatki iz pogodbe in po potrebi podatki o škodi posredovani proizvajalcem oz. uvoznikom vozil., npr. za ustvarjanje statistik.

Zunanji izvajalci storitev:
Za izpolnitev naših pogodbenih in zakonskih obveznosti deloma najemamo zunanje izvajalce storitev. Seznam prevzemnikov naročil in izvajalcev storitev, s katerimi sodelujemo in s katerimi nimamo sklenjenih le začasnih poslovnih odnosov, si lahko ogledate v vsakokrat aktualni različici na naši internetni strani na naslovu www.cargarantie.com/datenschutz.

Nadaljnji prejemniki:
Poleg tega lahko posredujemo vaše osebne podatke dodatnim prejemnikom, kot so državni organi, zaradi izpolnitve zakonsko določenih obveznosti sporočanja (npr. davčni organi ali organi kazenskega pregona).

Trajanje hrambe podatkov
Vaše osebne podatke izbrišemo takoj, ko za zgoraj navedene namene niso več potrebni. Pri tem se lahko zgodi, da so osebni podatki shranjeni v časovnem obdobju, v katerem se lahko uveljavljajo zahtevki zoper našo družbo (zakonsko določen rok zastaranja od tri do trideset let). Poleg tega shranjujemo vaše osebne podatke, če tako določajo zakonske zahteve. Ustrezne obveznosti dokazovanja in hrambe nastanejo med drugim na podlagi nemškega Trgovinskega zakonika (Handelsgesetzbuch), nemškega Davčnega zakonika (Abgabenordnung) in nemškega Zakona o preprečevanju pranja denarja (Geldwäschegesetz). V skladu s tem veljajo roki za hrambo do deset let.

Pravice zadevnih posameznikov

Nameni in pravne podlage obdelave podatkov
Vaše osebne podatke obdelujemo ob upoštevanju Splošne uredbe EU o varstvu podatkov (GDPR) ter drugih predpisov s področja varstva osebnih podatkov.
Če vložite zahtevek za zavarovalno varstvo, moramo obdelovati vaše navedbe iz tega zahtevka za sklenitev pogodbe in oceno tveganja, ki ga prevzamemo. Če je zavarovalna pogodba sklenjena, obdelamo te podatke zaradi izvedbe pogodbenega razmerja, npr. za izdajo police ali računa. Navedbe o škodi potrebujemo npr. za preverjanje, ali je nastopil zavarovalni primer in kolikšna je škoda.

Sklenitev oz. izvajanje zavarovalne pogodbe za jamstvo ni mogoča brez obdelave vaših osebnih podatkov.

Poleg tega potrebujemo vaše osebne podatke za ustvarjanje statistik, specifičnih za zavarovanje, npr. za oblikovanje novih tarif ali izpolnitev zakonskih zahtev.
Pravna podlaga za te obdelave osebnih podatkov za predpogodbene in pogodbene namene je člen 6, odstavek 1 b) GDPR.
Vaše podatke obdelujemo tudi, da bi varovali lastne upravičene interese ali upravičene interese tretjih oseb (člen 6, odstavek 1 f) GDPR). To je lahko zlasti potrebno:

  • zaradi zagotavljanja varnosti IT in delovanja IT,
  • zaradi trženja lastnih zavarovalnih produktov,

Dajalec zavarovanja:
Tveganja, ki jih prevzamemo, zavarujemo pri posebnih zavarovalniških družbah (dajalcih zavarovanja). Zato je lahko nujno, da vaše podatke iz pogodbe in po potrebi podatke o škodi posredujemo dajalcu zavarovanja, tako da si lahko ta ustvari predstavo o tveganju ali zavarovalnem primeru.

Proizvajalec/uvoznik vozil:
Pri jamstvenih oz. zavarovalnih shemah, dogovorjenih s proizvajalci oz. z uvozniki vozil, so vaši podatki iz pogodbe in po potrebi podatki o škodi, posredovani proizvajalcem oz. uvoznikom vozil,. npr. za ustvarjanje statistik.

Zunanji izvajalci storitev:
Za izpolnitev naših pogodbenih in zakonskih obveznosti deloma najemamo zunanje izvajalce storitev.

Nadaljnji prejemniki:
Poleg tega lahko posredujemo vaše osebne podatke dodatnim prejemnikom, kot so državni organi, zaradi izpolnitve zakonsko določenih obveznosti sporočanja (npr. davčni organi ali organi kazenskega pregona).

Trajanje hrambe podatkov
Vaše osebne podatke izbrišemo takoj, ko za zgoraj navedene namene niso več potrebni. Pri tem se lahko zgodi, da so osebni podatki shranjeni v časovnem obdobju, v katerem se lahko uveljavljajo zahtevki zoper našo družbo (zakonsko določen rok zastaranja od tri do trideset let). Poleg tega shranjujemo vaše osebne podatke, če tako določajo zakonske zahteve. Ustrezne obveznosti dokazovanja in hrambe nastanejo med drugim na podlagi nemškega Trgovinskega zakonika (Handelsgesetzbuch), nemškega Davčnega zakonika (Abgabenordnung) in nemškega Zakona o preprečevanju pranja denarja (Geldwäschegesetz). Za obdelavo podatkov v skupini podjetij Car-Garantie je odgovorno podjetje, pri katerem se prijavljate. Kontaktne podatke našega pooblaščenca za varstvo podatkov najdete v rubriki »Imenik javnih postopkov/splošne informacije o varstvu podatkov« v razdelku Varstvo podatkov na našem spletnem mestu.

Katere kategorije podatkov se uporabljajo in od kod izhajajo?
H kategorijam osebnih podatkov, obdelanih in zbranih v postopku prijave (podatki, ki jih lahko povežemo z vami), spadajo predvsem vaši matični podatki (ime, priimek, nazivi), kontaktni podatki (zasebni naslov, številka mobilnega/stacionarnega telefona, e-poštni naslov) ter drugi podatki, ki nam jih posredujete (npr. življenjepis, poklicna pot itn.). Vaše osebne podatke bomo praviloma zbrali neposredno od vas v okviru postopka prijave. Poleg tega lahko pridobimo podatke od tretjih oseb (npr. posredovanje zaposlitve), katerim ste navedli svoje podatke za posredovanje. 

Poleg tega obdelujemo osebne podatke, ki jih pridobimo iz javno dostopnih virov (ki smo jih z dovoljenjem pridobili npr. iz poklicnih družbenih omrežij, npr. Xing ali linkedin). Prek zadevnega vira (npr. Xing) bomo stopili v stik z vami, da boste lahko videli, kje smo dobili vaše podatke. Pri tem izhajamo iz tega, da se strinjate z objavo vaših podatkov prek vzpostavitve stika z vami. Vsekakor imate pravico, da to soglasje kadar koli prekličete. Za kakšne namene in na kakšni pravni osnovi se obdelujejo moji podatki?
Vaše osebne podatke obdelujemo na osnovi določb Temeljne uredbe EU o varstvu podatkov (GPRD), Zakona o varstvu podatkov ter drugih zadevnih zakonov (npr. Zakon o dopustu, Zakon o delovnem času, Splošni zakon o enaki obravnavi). Obdelava podatkov je namenjena izvedbi in poteku postopka prijave in oceni, v kolikšni meri ste primerni za zadevno delovno mesto. Obdelava vaših prijavnih podatkov je potrebna, da se lahko odločimo glede utemeljitve delovnega razmerja. Prednostna pravna osnova za to je 6. člen, 1. b) odstavek GDPR. Poleg tega lahko uporabimo soglasja skladno s 6. členom, 1 a) odstavkom 7 GDPR kot predpis za dovoljenje glede varstva podatkov.

V posameznih primerih bomo obdelali vaše podatke, vendar le po njihovi anonimizaciji, da zaščitimo lastne upravičene interese. Tako se izvaja obdelava podatkov izključno v statistične namene (npr. preiskave glede vedenja kandidata). Ustvarjanje takšnih statistik se izvaja izključno za lastne namene in v nobenem primeru ni personalizirano, temveč anonimizirano. Če obdelujemo posebne kategorije osebnih podatkov skladno s 1. odstavkom 9. člena GDPR (npr. podatke o zdravju), to temelji na vašem soglasju skladno z odstavkom 2 a 9. člena GDPR, če ne veljajo zakonska dejanska stanja za dovoljenje, kot npr. 2 b odstavek 9. člena. Če bomo želeli obdelati vaše osebne podatke za namene, ki niso navedeni zgoraj, vas bomo o tem predhodno obvestili.

Kdo dobi vaše podatke?
Znotraj naše skupine podjetij prejmejo vaše osebne podatke le osebe in delovna mesta, ki jih potrebujejo v okviru postopka prijave in s tem povezanimi zakonskimi in (pred-) pogodbenimi dolžnostmi. Znotraj naše skupine podjetij bodo vaši podatki posredovani določenim podjetjem, če ta podjetja centralno skrbijo za naloge obdelovanja podatkov za podjetja v skupini (npr. upravljanje s prijavami po vsej skupini). Poleg tega lahko vaše osebne podatke posredujemo drugim prejemnikom zunaj podjetja, če je to potrebno za uvedbo delovnega razmerja.

Kakšne pravice glede varstva podatkov lahko kot prizadeti uveljavljam?
Skladno s 15. členom GDPR lahko zahtevate informacije o svojih shranjenih osebnih podatkih. Poleg tega lahko skladno s 16., 17. in 18. členom GDPR pod določenimi pogoji zahtevate popravljanje, brisanje in omejevanje obdelave podatkov. Skladno z 20. členom GDPR imate pravico do izročitve posredovanih podatkov v strukturirani, običajni in strojno čitljivi obliki. Če obdelujemo vaše podatke za zaščito upravičenih interesov (točki e in f 1. odstavka 6. člena), lahko ugovarjate tej obdelavi skladno z 21. členom GDPR. Če boste uveljavljali svojo pravico do ugovora, zadostuje npr. e-poštni dopis na naslov datenschutz(at)cargarantie.de z zadevo »Varstvo podatkov«. Vaših osebnih podatkov v tem primeru ne bomo več obdelovali, razen če lahko dokažemo nujne razloge za varstvo podatkov pri obdelavi, ki presegajo vaše interese, pravice in svoboščine ali če je obdelava namenjena za uveljavljanje, izvajanje ali zaščito pravnih zahtevkov.

Skladno s 3. odstavkom 7. člena GDPR imate pravico, da morebiti dodeljeno soglasje skladno s točko a 1. odstavka 6. člena ali 2. odstavka 9. člena za obdelavo osebnih podatkov kadar koli brez utemeljitve prekličete, pri čemer ostaja veljavna zakonitost izvedene obdelave zaradi soglasja do preklica. Poleg tega imate skladno s 77. členom GDPR pravico do pritožbe pri nadzornem organu, pristojnem za varstvo podatkov.

Kako dolgo hranite moje podatke?
Vaše osebne podatke bomo izbrisali 6 mesecev po končanem postopku prijave. To ne velja, če zakonske določbe nasprotujejo brisanju ali če je potrebna dodatna hramba za namene dokazovanja. Če je prišlo do sklenitve delovnega razmerja, bomo prevzeli vaše podatke v naš digitalni sistem za vodenje evidenc osebja. 

Ali ste dolžni zagotoviti vpogled v podatke?
V okviru vaše prijave smo dolžni zagotoviti vpogled v vaše osebne podatke, ki so potrebni za izvedbo postopka prijave in oceno o primernosti. Brez teh podatkov ne moremo izvesti postopka prijave in sprejeti odločitve o utemeljitvi zaposlitvenega razmerja.

V kolikšni meri se izvaja avtomatizirano odločanje o posameznih primerih ali ukrepih za profiliranje?
V posameznih primerih uporabljamo avtomatizirane postopke obdelave in/ali profiliranje za podporo pri sprejemanju odločitev pri postopku prijave. V teh primerih predhodno pridobimo posebne podatke skladno s točko f 2. odstavka 13. člena GDPR.

Pri jamstvenih oz. zavarovalnih shemah, dogovorjenih s proizvajalci oz. z uvozniki vozil, so vaši podatki iz pogodbe in po potrebi podatki o škodi, posredovani proizvajalcem oz. uvoznikom vozil,. npr. za ustvarjanje statistik.

Zunanji izvajalci storitev:

Nadaljnji prejemniki:

Poleg tega lahko posredujemo vaše osebne podatke dodatnim prejemnikom, kot so državni organi, zaradi izpolnitve zakonsko določenih obveznosti sporočanja (npr. davčni organi ali organi kazenskega pregona).

Trajanje hrambe podatkov

Vaše osebne podatke izbrišemo takoj, ko za zgoraj navedene namene niso več potrebni. Pri tem se lahko zgodi, da so osebni podatki shranjeni v časovnem obdobju, v katerem se lahko uveljavljajo zahtevki zoper našo družbo (zakonsko določen rok zastaranja od tri do trideset let). Poleg tega shranjujemo vaše osebne podatke, če tako določajo zakonske zahteve.
